It is obligatory to give a lawyer or lawyers power of attorney to follow legal acts and transactions of real persons and legal entities through judicial organs and execution offices in accordance with Law No. 1136 on Lawyers and Notary Public.
An important reminder: the power of attorneys for the divorce, alimony, recognition and enforcement cases must include a special authority and photograph. Otherwise, court acceptance is not possible.
Turkish nationals residing abroad can apply for power of attorney to the Turkish Consulate closest to them, giving such necessary information (names of lawyers, TR ID numbers, addresses) as to which lawyer or lawyers they want to give the power of attorney.
In case where the Turkish nationals (the same shall also apply if one of the citizens is a Turkish citizen and the other is a foreign citizen) divorcing through the foreign judicial bodies want the Turkish judicial organs to recognize their divorce, an apostille authenticating documents for use in foreign countries must be attached. Otherwise, the acceptance of the power of attorney in Turkey is not possible.
Another important thing to remember is that the general power of attorney is not accepted for the procedures and operations in the land registry; the “special power of attorney” including special authorities is required. In addition, our clients shall not give us the “general power of attorney” for the procedures and operations in the notary public; they must give us the “special power of attorney”.
